Background and Experience
I have almost 40-years experience in the construction industry, which has been gained in the United Kingdom, West Africa and the Middle East. I have been based in the Middle East for the past 16-years where I have worked on projects in Bahrain, Saudi Arabia, Jordan, Oman and the United Arab Emirates.
I am a Fellow of Quantity Surveyors International, a Member of the Chartered Institution of Civil Engineering Surveyors and an Associate of the Chartered Institute of Building, an Associate of the Chartered Institute of Arbitrators I am also a member of the Dispute Resolution Board Foundation and a Corporate Panel Member of the Dispute Board Federation, both of which are international organisations that actively promote the avoidance and resolution of construction disputes.
I have held senior contracts, commercial and project management positions with contractors, sub-contractors and consultants, including several years operating my own practice in the UK which offered quantity surveying, estimating and project management services to contractors, subcontractors, consultants and private clients.
I have been involved in a wide variety of construction projects including super high-rise, large low-rise housing developments, hotels, shopping malls, airports, hospitals, heavy civil engineering, process plants, marine works, water treatment plants, water reclamation plants, highways, pipelines, marine works, desalination plants and royal palaces.
My project and company management skills together with experience gained in a variety of disciplines and projects within the construction industry have led me to specialise in the field of construction contractual issues, claims and dispute management. Whilst the avoidance of contractual disputes is a priority, if disputes do occur I favour a structured and proactive approach to their management in order to protect the contractual entitlements of my clients.
My personal background and experience, which includes involvement at many levels and disciplines within the construction industry provides a direct benefit to my clients, in that I have the ability to see matters from the perspective of all parties, in whichever sector of the industry they operate and to identify with their particular needs. This experience also means that I can relate to the individual project personnel through my own past hands-on experience.

'It's not a lawyer that knows the most law who wins, but the one that has the best prepared case'
Claims are almost inevitable on a construction project and in times of recession when margins are low, claims always proliferate. If the project does not proceed as originally envisaged, either because of changes, or through acts of prevention, then claims can very often add up to substantial sums. A successful claim leading to additional time or payment will often make the difference between success and failure in achieving the party's commercial goals.
From a contractor or sub-contractors point of view, in order for a claim to succeed and to be resolved in a timely manner, it is essential that claims are presented in a professional way and that they include the essential elements to enable the reviewer to make a determination. Failure to do so will often result in either delay in resolution or outright rejection of the claim.
When substantial sums of money at risk, it is essential that adequate resources are deployed to recover them. It is however, often the case that the parties do not have people with the specialist knowledge and expertise to successfully produce robust claims, or if they do, such resources are fully occupied with the day-to-day responsibilities on the project and do not have the time to devote to dealing with what may be time consuming and complex claim issues. The result of failing to properly prepare or respond to claims is that the claimant is inadequately compensated, or that the respondent finds himself in a dispute situation or even litigation.

Claim Review, Determination or Defence
If the project does not proceed as originally envisaged, then claims can very often add up to substantial sums. Adequately defending against claims or ensuring that the claimant's claims are justified and correctly evaluated will often make the difference between bringing in a project in accordance with the budget and programme or not.
From the employer or consultant's perspective, it is important to ensure not only that claims are justified under the contract, but that they are evaluated accurately, determined correctly and that the response to the claimant addresses all essential elements thouroghly.
When substantial sums of money at risk, it is essential that adequate resources are deployed to deal with them. It is however, often the case that the parties responsible for dealing with claims do not have people with the specialist knowledge and expertise to successfully manage claims, or they do not have adequate time to deal with large and complex claim issues. Claim Enhancement and Presentation
In some cases, clients have the resources to prepare a claim themselves but possibly do not have the required experience to make the claim submission document as effective as it could be. Often the essential elements of a robust claim are omitted which weakens the case, or the events are not adequately dealt with or substantiated. If this is the case, the claim could at worst be rejected or at best require revision and resubmission, which will delay bringing the matter to resolution.
I can offer a service whereby I will review your claim document, suggest ways it should be enhanced and if necessary, edit your claim so that it contains all the essential elements for success.

Construction contracts are invariably complex and it is a fact of life that one party is invariably trying to either cover up their own errors or omissions or seeking to gain some sort of advantage over the other party.
Conditions of contract, the particular conditions of application, specifications and drawings, usually contain ambiguities and conflicts which will lead to differences of opinion between the parties and this is especially so if the contract documents have not been carefully drafted and compiled.
I am able to offer contractual advice to clients in order to protect their commercial interests from the tender to the final account by way of the following services:

• Assistance in drafting the final conditions of contract to
reflect post tender negotiations.
• Advice on the interpretation of the contract.

For both the employer and the contractor, the commencement of any project is an intense time. Project staff have often not worked together, mobilisation is in full swing, the project team are finding their feet and yet this is one of the most important times for the project one which must be used for setting up systems and procedures in order to effectively manage the project.

The use of Dispute Boards on construction projects is becoming increasingly popular as a means of avoiding the cost long time periods of arbitration proceedings. The World Bank and other banks such as the European Investment Bank, the European Bank for Reconstruction and Development and the Asian Development Bank now insist on the inclusion of dispute boards in contracts for any project funded by them, as do the European Union. The International Chamber of Commerce also recommends their use. FIDIC have incorporated provisions for dispute boards in the 1999 editions of their standard forms of construction contracts, as do the Institution of Civil Engineers.
I am a Corporate Panel Member (MDBF) of the Dispute Board Federation based in Geneva and a Member of the Dispute Resolution Board Foundation, based in the USA, both of which are organisations dedicated to preventing and resolving construction industry disputes and provide high levels of training for their members in order that they may successfully carry out the duties and responsibilities of Dispute Board members.

If a project becomes firmly locked in dispute, it is often believed that the only resolution is arbitration, which inevitably becomes a time consuming and costly exercise for both parties. If there is a willingness from the parties to actually bring the matter to a resolution, there is however an alternative to arbitration which is to employ the services of an industry expert to examine the issues of the dispute and provide an impartial decision to the parties on the merits of their opinions.

Commercial Manager Jacobs International Holdings Inc. (Project Managers) (March 2010 - April 2011)
Responsible for a team of 12 staff managing all contractual and commercial aspects on the construction phase of a US$1.282M hospital project in Abu Dhabi. Managing variations, claims, contractual matters, agreement of contract terms and conditions.
Commercial Manager, Ahmed Janahi Architects (January 2003 - September 2003)
Short-term appointment to assist in re-organisation of the practice in anticipation of the award of a multi-million US$ landmark project. Duties included the review, improvement and standardisation of forms of contract, the creation of commercial procedures. Also review and formalisation of the management structure and systems and procedures to obtain ISO 9002 accreditation. Review and an-depth review of IT systems and proposals for upgrading.
Project Director, Morganti Group Inc. (Project Managers) (July 2007 - March 2010)
Responsible for directing the Project Management team to ensure that projects were designed and constructed in accordance with the clients requirements in terms of cost, time and quality.
The following projects were in design phase and duties included preparation of procurement strategies, monitoring of design consultants, appointment of other consultants, drafting and negotiation of contracts, development of the project budgets:
* A twin 100-storey mixed-use development with a budget of
US$1.9Bn.
* A 125-storey mixed-use development with a budget of
US$1.4Bn.
Latterly I was appointed to manage the closeout of Abu Dhabi Airport Etihad Terminal 3 Expansion Project including the finalisation of variations in the sum of US$115 M and claims in the sum of US$14M.
Projects Manager, The Marble Restoration Company, Bahrain (March 2001 January 2003)
Company carrying out marble restoration and maintenance, supply and installation of marble, granite and other natural and agglomerated stone, the supply and installation of specialized render systems and operating an independent pest-control division. Initial duties included review of the existing management and administration procedures and the introduction of efficient systems, procedures and QA/QC systems throughout all levels of the company. Introduced computerized systems for estimating, site reports, and sales reports. Created formalized documentation for use in the various procedures. Responsible for day-to-day management of the company activities including estimating, sales, sourcing of materials, purchasing, workshop production and site installations to produce the required profitability to the management.
Senior Contracts Manager, Jacobs-CRSS International (Project Managers) (September 2006 - June 2007)
Responsible for contracts management for company regional activities in the UAE. Primarily involved in the Capital Plaza Project Abu Dhabi, a $300M development consisting of 5 no towers of up to 45-stories, a 4-level basement and 7-level podium. Responsibilities include management of claims and disputes, contractual issues and maintaining an overview of the commercial management and contract administration teams.
Freelance Construction Consultant, Arabian Gulf (February 1998 February 2001)
Major assignments include the following
Raymond International: Project Manager for pipeline services for major water transmission project in Bahrain, including supply of pipeline materials, concrete lining, welding and coating, creation of QA/QC procedures, records and documentation, preparation of claim for extension of time and additional costs which was eventually taken to arbitration. Management of arbitration proceedings on behalf of contractor.
Atlas Contracting: Project Manager for mechanical and steel installation contractors on 30-million gallon/day desalination plant. Directly responsible for management of 250 site operatives and staff to profitably complete the project to programme.
James R Knowles: Preparation of claims for extension of time and additional costs for package subcontractors on Burg Al Arab Hotel, Dubai and ommercial site organisation for cladding package subcontractors on the Emirates Towers project.
Raymond International: Project Manager for concrete weight coating to 18-km pipeline for main contractors Christiani and Nielsen. Duties included developing system to suit application, mobilisation and procurement of resources, training of operatives, QA/QC procedures, commercial management, preparation and successful negotiation of claim for extension of time and additional costs, daily management of the project.
Jalal-Costain: Preparation of successful claim for main contractors on National Bank of Bahrain Headquarters; a 25 storey commercial building in Bahrain.
Senior Consultant, Knowles Middle East, United Arab Emirates (International Construction Contracts Consultants) (October 2003 - September 2006)
Providing contractual services and advice to employers, contractors and subcontractors in the form of one-off briefs and on-going services on various projects. Dispute management including claim preparation of behalf of contractors and subcontractors and determination and defence of claims on behalf of consultants and clients. Contractual reports and advice to employers, contractors and subcontractors on an ad-hoc basis. Projects include landmark commercial buildings, shopping malls, multi-story residential buildings, low and medium rise residential developments in Abu Dhabi and Dubai. Acted as lead consultant on several projects that demanded a team of consultants working on the same issue; such a role included overall coordination and management of the team. During this period also had articles published in various trade and professional publications.

It includes discussions of various types of claim, the essential elements that should be included in every claim or response and how they should be presented. It also includes worked examples of claims based upon the FDIC form of contract, together with narratives that demonstrate in a practical manner, how the topics discussed may be presented in typical situations.
This practical, hands on guide is essential reading for any construction industry professional who is involved in claims at any level.

The first thing that strikes one, having read the first few pages, is the easy style Andy has adopted, which made my task a pleasure. It is also obvious from the outset that the author has had a great deal of hands-on experience at the coalface of preparing and responding to claims and this oozes from the pages.
First and foremost, this book is international in its outlook and will be useful for those involved in claims on a worldwide basis. This is essential reading for anyone who is preparing a claim for the first time. For those of us with experience aplenty, the book provides an excellent aide-memoire and will ensure that nothing is missed. The book is, without doubt, fully comprehensive and goes through the preparation of a claim from A to Z.
In any campaign, and the preparation, submission and negotiation of a claim are something of a campaign, it is essential to have a strategy and this is dealt with at the outset. Claims may be related to variations, delays caused by the employer and neutral events which could involve extensions of time, prolongation costs, acceleration and disruption, all of which are fully explained.
Claims are nearly always prepared by reference to the conditions of contract. The book refers to the FIDIC conditions, but this should not put off those who are involved with contracts where other standard conditions apply. The comprehensive nature of the book would easily enable the reader to slot the advice provided on its pages into other standard conditions of contract. The book leaves nothing to chance when referring to the conditions that are applicable when preparing a claim.
The need for a stand-alone claim, accompanied by all documents referred to therein and the fact that claim must be user-friendly is dealt with. These may seem fairly basic matters, but I would say that in excess of half the claims prepared fail to follow this simple procedure.
Andy also deals with what he considers to be the essentials of a successful claim: CEES Cause, Effect, Entitlement and Substantiation. By way of illustration, the book provides in detail the CEES of a delay-and-disruption claim on an 84-dwelling project and there is also an example claim of an extension of time and additional payment for prolongation arising on a multi-storey project.
The style and formatting of the claim document are dealt with down to such detail as the content and layout of the cover to the claim. Finally, from his experience, Andy deals with how a response to a claim should be undertaken in a professional manner.
I like the book and have no hesitation in recommending it to students, beginners, those involved on a day-to-day basis with time and cost on projects, as well as the seasoned claims consultants.
It will certainly have a place on my bookshelf to allow me, having pre- pared a claim, to check to ensure that I havent missed anything.
